What is Ordinance 017992 about?

Recently the City of El Paso passed Ordinance 017992 which is known as the Safe Soliciting Ordinance. This ordinance is in response to safety concerns from the community. We are asking solicitors to avoid all medians, stay at least 15 feet away from the corner of any intersection, and to refrain from behaviors that might be considered aggressive or dangerous.

Why has the City approved this ordinance?

Aggressive solicitation is a growing social and public safety concern across the country and the locations indicated in the ordinance are high-risk areas where incidents are likely to occur. The City has passed the ordinance in order to address concerns about aggressive solicitations raised by its citizens. Besides aggressive solicitation, soliciting in dangerous areas like medians is also a concern the ordinance intends to address. The El Paso Police Department is the agency enforcing the ordinance.

Under the ordinance, what is considered solicitation and who is
considered a solicitor?

A solicitor is an individual or a group of individuals who are requesting a donation or thing of value. It may include an exchange of money for an item or service of some value. Solicitors can be individuals, organizations, or a group of individuals who are fundraising.

Does the Safe Soliciting Ordinance target a specific population?

This ordinance is directed at the community as a whole.  In addition to those soliciting; citizens who donate, contribute, or purchase from a solicitor from their vehicle on a public road can be fined as well. 

What areas are restricted for solicitors under the new ordinance?

Solicitation is restricted within 15 feet from the corner of any intersection or from any median.

What behaviors are solicitors being asked to refrain from in the Safe Soliciting Ordinance?


  • Soliciting in restricted areas as outlined in Ordinance 017992
  • Physical contact without consent
  • Repeatedly asking a person to donate or purchase after they’ve said no
  • Following a person after they’ve declined to donate or make a purchase
  • Blocking  a person or vehicle in efforts to solicit
  • Using obscene, abusive, and profane gestures or language in efforts to solicit

What happens to violators of the Safe Soliciting Ordinance?

Solicitors in violation of Ordinance 017992 can be given a warning or issued a citation if the solicitor is non-compliant after an initial warning.


 

Safe Soliciting

Solicitation is restricted at the following locations within the city of El Paso, Texas:

  • Within 15 feet from the corner of any intersection
  • All medians

Aggressive solicitation is any of the following acts:

  • Soliciting in restricted areas as outlined in the ordinance
  • Physical contact without consent
  • Repeatedly asking a person to donate or purchase after they’ve said no.
  • Following a person after they’ve declined to donate or make a purchase.
  • Blocking a person or vehicle in efforts to solicit
  • Using obscene, abusive, and profane gestures or language in efforts to solicit
